1. Acceptance of Terms

By accessing and using the Chybx Studios website and services ("Services"), you accept and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you should not use our Services.

These Terms apply to all visitors, users, and others who access or use the Services, including but not limited to clients who commission custom development work.

2. Description of Services

Chybx Studios provides custom development services including but not limited to:

  • Minecraft plugin development (Spigot, Paper, BungeeCord, Velocity)
  • Minecraft mod development (Forge, Fabric)
  • Discord bot development and customization
  • Web dashboard and API development
  • Cross-platform integrations (Minecraft-Discord bridges)
  • Custom software solutions for gaming communities

All services are provided on a commission basis and are subject to availability.

3. User Accounts

To access certain features of the Services, you may be required to create an account using Discord OAuth2 authentication. You are responsible for:

  • Maintaining the confidentiality of your account credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use of your account

We reserve the right to suspend or terminate accounts that violate these Terms.

4. Commission Process

When commissioning work from Chybx Studios:

  • Consultation: All commissions begin with a consultation to discuss your requirements, timeline, and budget.
  • Quotation: After consultation, you will receive a detailed quote outlining the scope of work, deliverables, and pricing.
  • Payment: Payment terms will be specified in the quote. Typically, a deposit is required before work begins, with the remainder due upon completion.
  • Development: Work will be completed according to the agreed timeline, with regular progress updates.
  • Delivery: Upon completion and final payment, you will receive the finished product along with documentation and setup assistance.
  • Revisions: The scope of included revisions will be specified in the quote. Additional revisions may incur extra charges.

5. Payment Terms

Payment terms for commissioned work include:

  • All prices are quoted in USD unless otherwise specified
  • Payments are processed through PayPal or other agreed-upon payment methods
  • A non-refundable deposit (typically 50%) is required to begin work
  • Final payment is due before delivery of the completed work
  • Late payments may result in project delays or suspension

6. Refund Policy

Our refund policy is as follows:

  • Deposits are non-refundable once work has begun
  • If we are unable to complete the work as specified, a partial or full refund may be issued at our discretion
  • Refund requests must be made in writing and will be evaluated on a case-by-case basis
  • No refunds will be issued for completed and delivered work that meets the agreed specifications

7. Intellectual Property

Unless otherwise agreed in writing:

  • Upon full payment, you will receive a non-exclusive license to use the delivered work for your intended purpose
  • Chybx Studios retains the right to showcase the work in portfolios and marketing materials
  • You may not resell, redistribute, or claim the work as your own creation
  • Source code ownership will be specified in the project agreement
  • Any pre-existing code, libraries, or frameworks used remain the property of their respective owners

8. Confidentiality

We respect your privacy and will treat all project details as confidential. We will not share your project information, code, or business details with third parties without your consent, except as required by law.

9. Warranties and Disclaimers

Chybx Studios warrants that:

  • Delivered work will function as specified in the project agreement
  • Reasonable efforts will be made to ensure code quality and performance
  • Bug fixes for delivered work will be provided for a reasonable period after delivery (typically 30 days)

However, we disclaim all warranties regarding:

  • Compatibility with future updates to third-party software (Minecraft, Discord, etc.)
  • Performance on hardware or hosting environments not specified during development
  • Issues caused by modifications made by third parties
  • Any implied warranties of merchantability or fitness for a particular purpose

10. Limitation of Liability

To the maximum extent permitted by law, Chybx Studios shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from:

  • Your use or inability to use the Services
  • Any conduct or content of third parties on the Services
  • Any content obtained from the Services
  • Unauthorized access, use, or alteration of your transmissions or content

Our total liability for any claims arising from these Terms or your use of the Services shall not exceed the amount paid by you for the specific service giving rise to the claim.

11. Prohibited Uses

You agree not to use the Services:

  • For any unlawful purpose or in violation of any applicable laws
  • To harass, abuse, or harm another person
  • To impersonate any person or entity
  • To interfere with or disrupt the Services or servers connected to the Services
  • To attempt to gain unauthorized access to any portion of the Services
  • To commission work that violates the terms of service of third-party platforms (Minecraft EULA, Discord Terms of Service, etc.)

12. Third-Party Services

Our Services may integrate with or rely on third-party services including but not limited to:

  • Discord (for authentication and bot hosting)
  • PayPal (for payment processing)
  • Minecraft/Mojang (for plugin and mod development)

Your use of these third-party services is subject to their respective terms of service and privacy policies. We are not responsible for the practices of these third parties.

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of any material changes by posting the updated Terms on this page with a new "Last Updated" date. Your continued use of the Services after such changes constitutes your acceptance of the new Terms.

14. Termination

We may terminate or suspend your access to the Services immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms. Upon termination, your right to use the Services will cease immediately.

15. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any disputes arising under these Terms shall be resolved through good-faith negotiation or, if necessary, binding arbitration.

These Terms, together with any project-specific agreements, constitute the entire agreement between you and Chybx Studios regarding your use of the Services and supersede any prior agreements.
